Many people are taking advantage of the warmer weather to get outdoors and be active. With this increased activity comes a risk of injury from many sources. One all-too-common source for accidents can happen when cyclists and cars are traveling in the same area. One Florida man died recently after being allegedly hit by a car. His name has not been released, but it is possible that his family may decide to pursue a wrongful death claim against the driver who is accused of causing his death.

The accident happened when the cyclist was riding on the edge of a roadway. The car that is said to have struck him had apparently drifted slightly so that its edge was past the shoulder of the road. It allegedly hit the cyclist’s back tire and caused him to fall onto the hood of the vehicle. After the vehicle stopped, the man was thrown back on to the grass shoulder. Though first responders rushed to the scene, the man was declared dead when they arrived.

The woman driving the car that is accused of hitting the man has not been charged with any crime at this time. Police have not disclosed whether they intend to file any charges, nor have they discussed any investigation relating to the crash. It is not known whether there were any contributing factors that may have led to the accident.

The family of the Florida man who died could decide to file a civil wrongful death claim against the driver of the car, even if she never faces any criminal charges. A successful claim could result in financial restitution for his family that could be useful in covering unpaid medical bills, funeral costs or other expenses. Hopefully there will be answers soon and the family will be able to pick up the pieces after such a devastating loss.
